SWEEPSTAKES ENTRY PERIOD: The “Kmart Instant-Win” Sweepstakes, (“Sweepstakes” or “Promotion”) begins at 12:01 AM Eastern Time (“ET”) on Tuesday, August 3, 2010 and ends at 11:59 PM (“ET”) on Sunday, October 31, 2010.There will be three (3) Monthly Entry Periods during the Sweepstakes Entry Period (see below chart for details).
ELIGIBILITY: The “Kmart Instant-Win” Sweepstakes is open to legal residents of the 50 United States and the District of Columbia (U.S.), age 13 or older at the time of entry. Void outside the United States, in Puerto Rico, and wherever else prohibited by law. Employees of the LT Apparel Group, 100 West 33rd Street, Suite 1012, New York, NY 10001 (the "Sponsor"), Sears Holdings Corporation, their parent(s), affiliates, subsidiaries, advertising and promotion agencies, vendors, and immediate family (defined as spouse, IRS dependent, or biological, adoptive or step- mother, father, sister, brother, daughter or son, and each of their respective spouses) of, or who reside in the same household as, any person in any of the preceding categories, are not eligible to participate.
Note: The “K-Mart Instant-Win” Sweepstakes is not intended for and may not be used by children under the age of 13. The Sponsor and Sweepstakes Entities do not knowingly collect information from children under the age of 13 and do not target marketing/promotional efforts to children under 13. If you are under 13, you are prohibited from accessing and using The “Kmart Instant-Win” Sweepstakes site.
HOW TO ENTER: The Promotion is a daily Instant-Win Game, featuring an electronic spin device (the “Spinner”). To enter, visit www.ftsweeps.com, complete the online registration form in its entirety, including a valid email address and a password (for future visits), check the box to agree to and accept the terms of the Official Rules and submit to be taken to the Spinner. Click the Spinner to play and you will be shown your winner or non-winner status at the end of the spin. By registering, you will receive one (1) Instant-Win Game play. Each day thereafter, during the Promotion Period, you will be able to return to the site, enter your email address and password that you used for registration and play the Instant-Win Game once per day.
Limit: One (1) Instant-Win Game play per person, per email address, per mailing address during each day of the Promotion Period.
In the event of a dispute, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries made by any other individual or entity that is not the person named on the submitted entry, or made in any manner inconsistent with these Official Rules, will be declared invalid and disqualified from this Promotion. All winning claims are subject to verification by Sponsor and/or the Administrator, whose decisions are binding. Even if the Instant-Win Game shows that you are a winner, you are not a winner until your eligibility and the potential winning game-play has been verified. No proof of winning will be accepted. Only the Sweepstakes Administrator’s verification process shall be conclusive and final.
PRIZE DRAWINGS: There will be three (3) Monthly Entry Periods during the Instant-Win Sweepstakes Entry Period. Prizewinners will be selected in a series of random instant-win drawings from among all eligible entries received within the corresponding Entry Period. To be eligible for the First Entry Period, your online entry must be received between 12:01 AM (ET) on 8/3/2010 and 11:59 PM (ET) on 8/31/2010 (“First Monthly Entry Period”). For each subsequent Monthly Entry Period thereafter, your online entry must be received between 12:01 AM (ET) on the first day of that applicable month and 11:59 PM (ET) on the last day of that same month (“Monthly Entry Period”). Non-winning entries from each Monthly Entry Period will not be rolled over to the subsequent Monthly Entry Period. They will only be eligible to win a prize for the month during which they are received.
PRIZES & APPROXIMATE RETAIL VALUES (“ARV”): Two Hundred and twenty-eight (228) Instant Win Prizes, of Kmart Gift Cards with a range in value from $10 - $1,000, noted in the chart below, will be awarded during the Three Monthly Sweepstakes Entry Periods.
Month One Entry Period - 8/3-8/31/10: Two (2) Instant-Win Grand Prizes of a $1000 Kmart gift card. (ARV: $2,000); Two (2) Instant-Win First Prizes of a $500 Kmart gift card. (ARV: $1,000); Six (6) Instant-Win Second Prizes of a $100 Kmart gift card. (ARV: $600) and Sixty (60) Instant-Win Third Prizes of a $10 Kmart gift card (ARV: $600). Seventy total prizes (70) prizes will be awarded with a Total ARV of $4,200.
Month Two Entry Period - 9/1-9/30/10: One (1) Instant-Win Grand Prize of a $1000 Kmart gift card. (ARV: $1,000); One (1) Instant-Win First Prize of a $500 Kmart gift card. (ARV: $500); Eight (8) Instant-Win Second Prizes of a $100 Kmart gift card. (ARV: $800) and Sixty (60) Instant-Win Third Prizes of a $10 Kmart gift card. (ARV: $600). Seventy (70) total prizes will be awarded with a Total ARV of $2,900.

If you are the first player to successfully play the Instant-Win Game at or after a selected winning time, you will be a potential winner (pending confirmation) of the prize. Prizes will be awarded in the name of the winner’s parent or legal guardian, if the winner is a minor. Odds of winning an Instant Win Prize depends on the total number of eligible entries received during each month of the Promotion Period.
Gift Cards are not redeemable for cash and will not be replaced if lost or stolen. Gift Card usage subject to the complete terms and conditions listed on the redemption instructions provided to each winner.
WINNER NOTIFICATION: The Kmart Instant-Win Sweepstakes is under the administration of the US Sweepstakes & Fulfillment Company, an independent agent of the Sponsor whose decisions are final.
Grand Prize Winners will be confirmed via email and/or phone, and will be required to sign and return, within ten (10) days of notification, an Affidavit of Eligibility and a Liability Waiver and where allowable, a Publicity Release (collectively, "the Releases"). Noncompliance will result in disqualification and an alternate winner being selected. Winner is responsible for all federal, state, local and income taxes associated with winning prize. Winner will be required to furnish his/her social security number for the sole purpose of preparation of any tax forms as required by law.
First, Second, and Third Prize Winners will be notified by email and requested to confirm their mailing address via return email. Prizes will be sent to the mailing address on the entry form or new mailing address provided via email response from potential winner within 4-6 weeks of winner being verified.
PRIZE CONDITIONS: If a winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner's parent or legal guardian. The winner must be thirteen (13) years of age or older, and the parent or legal guardian must be able to provide proof that the winner was that age during the official Entry Period. The parent/legal guardian of the winner shall be responsible for all taxes on prize, if applicable.
If prize notification is returned as undeliverable or if a selected winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the corresponding prize will be forfeited and an alternate winner will be selected in a separate random drawing. Prizes are not redeemable for cash. Prizes are non-assignable or transferable. No substitution is permitted except if prize or prize component is unavailable, in which case a prize of equal or greater value will be awarded. Any other incidental expenses on prize not specified herein are the sole responsibility of each winner. Except where prohibited by law, entry and acceptance of prize constitute permission to use each winner's name, prize won, hometown, likeness for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission. Winner is responsible for all federal, state, and local sales and income taxes, if applicable.
Winner acknowledges that the Sponsor and all other businesses affiliated with this Sweepstakes and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative the quality, conditions, fitness or merchantability of any aspect of the prize being offered. Entry and acceptance of any prize constitutes permission for Sponsor or their agent(s) to use winner's name, prize won, hometown and likeness for online posting and promotional purposes without further compensation, except where prohibited by law.
TERMS AND CONDITIONS: This Promotion is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and Independent Sweepstakes Administrator, and waive any right to claim ambiguity in regard to the Promotion mechanics, and/or the interpretation of these Official Rules. All entrants, and any selected winners, agree to release, discharge, indemnify and hold harmless the Sponsor, any vendors/prize providers that may be associated with this promotion, and the respective officers and employees of these entities, from and against any claims, damages or liability due to any injuries, damages or losses to any person or property of any kind resulting in whole or in any part, directly or indirectly, from participation in this promotion, or for any prizes won.
PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTY, GUARANTEE OR REPRESENTATION OF ANY KIND, EXPRESSED OR IMPLIED (INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE).
LIMITATIONS OF LIABILITY: Incomplete, corrupted or untimely entries are void and will be disqualified. Sponsor and its agencies are not responsible for incomplete, lost, untimely, illegible, or otherwise destroyed or corrupted entries or game piece requests or for incomplete, lost, interrupted or unavailable network, server or other connections, miscommunications, computer or software malfunctions or telephone transmission problems or technical failures, garbled transmissions, damage to a user’s computer equipment (software or hardware) or other errors or malfunctions of any kind whether human, mechanical, electronic or otherwise. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. The Website's database clock will be the official timekeeper for this Promotion. Sponsor reserves the right at its sole discretion to modify or cancel this Promotion at any time for any reason without notice or obligation. Sponsor, its affiliate companies, parents, subsidiaries, officers, directors, and agents are not responsible for any incorrect or inaccurate information, including, without limitation, that caused by Web site users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error which may occur in the processing of submissions in the Promotion. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Promotion. If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor may, in its sole discretion, void any suspect entries and (a) cancel, modify or terminate the Promotion (or any portion thereof); (b) modify the Promotion or suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; or (c) award the prizes from among the eligible, non-suspect entries received up to the time of the impairment. Sponsor is not responsible for any technical or human error which may occur in processing entries for random drawings. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
